Terms of service.

These terms govern your use of the SparkNow website and services provided by SPARKNOW TEKNOX PRIVATE LIMITED. By creating an account or using the services, you agree to them.

The services

SparkNow provides SMS, WhatsApp Business API, RCS, voice (OBD), cloud call center, AI voice agent and AI chatbot services, along with a web panel and APIs. Features may change as we improve the platform.

Your account

• Give accurate business and KYC details and keep them up to date.
• Keep your passwords and API keys secure. You are responsible for activity on your account.
• Tell us immediately about any unauthorised use.

Acceptable use

You must have your recipients' consent and follow all applicable rules, including TRAI regulations, DLT registration, DND preferences, calling hours and Meta's WhatsApp Business policies. You must not send spam, fraudulent, misleading, offensive or illegal content, or impersonate anyone.

We may suspend or block messages, numbers or accounts that break these rules, and we may share information with operators or authorities when required.

Payments

• Services are prepaid unless agreed otherwise in writing.
• Prices exclude GST, which is added to every invoice.
• Operator, Meta and other third-party charges may change, and we will reflect changes in your rates.
• Refunds follow our refund policy.

Delivery

We route messages and calls through telecom operators and platform partners. Delivery depends on networks, handsets, recipient settings and third-party systems, so we cannot guarantee that every message or call is delivered or delivered within a specific time.

Your content

You own the content and contact data you upload. You give us permission to process it only to provide the services. You confirm you have the rights and consents needed to use it.

Our platform

SparkNow, its software, design and brand belong to us or our licensors. Reseller partners may use the white-label panel only under their partner agreement.

Limitation of liability

To the extent the law allows, our total liability for any claim is limited to the fees you paid us in the three months before the claim. We are not liable for indirect or consequential losses such as lost profits or data.

Suspension and termination

You may close your account at any time. We may suspend or end the services if you break these terms, fail to pay, or if required by law or by an operator.

Governing law

These terms are governed by the laws of India. Courts in Hyderabad, Telangana have exclusive jurisdiction.
